Unauthorized construction should be regularized only in exceptional circumstances: Supreme Court
New Delhi | In an important decision, the Supreme Court has issued important guidelines to curb illegal construction. The court has said that unauthorized construction cannot be legalized only on the basis of administrative delay, passage of time or investment of money. A bench of Justice JB Pardiwala and Justice R Mahadevan said that there should be rapid corrective action on post-construction violations as well. This includes demolishing the illegal part and punishing the guilty officers.
Along with this, the court upheld the decision to demolish illegal commercial construction in Meerut. In the 36-page decision, the Supreme Court said - Construction against the design approved by the local authority cannot be encouraged. Regularization of illegal and unauthorized construction can be done only once for a residential house in exceptional circumstances. The Supreme Court directed the Registrar to send a copy of the decision to all the High Courts.
